Assisting With All Your Probate Needs

Probate is the legal process by which a deceased person’s assets are transferred to his or her beneficiaries or heirs. Probate isn’t necessary when a person dies without assets, or when all of the assets have beneficiary designation. However, in most cases, it is needed.

The probate process in Minnesota can be complex. In order to move through the process as quickly and cost-effectively as possible, it’s important to work with an experienced probate lawyer.

How the Probate Process Works

Generally speaking, the probate process involves the following steps:

  • Gathering all of the deceased person’s property that is subject to probate
  • Paying all of the debts and taxes owed by the deceased person’s estate
  • Collecting any money that is owed to the estate
  • Resolving any disputes among heirs or devisees
  • Distributing the probate property to the appropriate heirs and devisees

Although the process seems pretty straightforward, it can be quite time-consuming, depending on the size and complexity of the estate involved. Let the experienced attorneys of Rasmussen Law advise you on how to proceed. We handle probate both in state and tribal courts.

Tribal Court Probate in Minnesota

Attorney Leif Rasmussen handles probate matters in tribal court in addition to state court. The probate process in tribal court follows the Tribal Probate Code. It serves the same purpose as probate in state court: distributing a deceased person’s assets according to his or her will.

Probate can take place in tribal court when the deceased person lived on a reservation or owned real property on the reservation. In some cases, probate may need to take place in more than one court if the deceased person owned property on and off of the reservation.

With more than two decades of experience in tribal court, you can count on Mr. Rasmussen to assist you through the complex probate process and answer any questions that arise along the way.
